An Act to provide for matters connected with the office of Attorney-General estab­lished under section 98 of the Constitution.Enacted by the Parliament of Lesotho.

1. Short title

This Act may be cited as the Office of Attorney-General Act 1994.

2. Principal legal advisor

The Attorney-General is the principal legal adviser to the Government of Lesotho.

3. Functions of the Attorney-General

In addition to the duties vested in the Attorney-General by the Constitution of Lesotho, the Attorney-General shall represent the Government of Lesotho in all legal proceedings in which the Government is a party.

4. Defence of matter at public expense

(1)Where the Attorney-General is of the opinion that it is in the pub­lic interest to do so, he may director that any matter before a court be defended at the expense of the State.
(2)a direction under subsection (1) is authority for the withdrawal of money from the Consolidated Fund for that purpose.

5. Staff

(1)In the exercise of his functions, the Attorney-General shall be assisted by staff appointed or employed under the Public Service Order 1970.
(2)For the purposes of the Public Service Order 1970, the staff of the Attorney-General shall be regarded as a department called the Attorney-General’s Chambers.

6. Legal cadre

(1)Public officers whose duties include the provision of legal servic­es to the Government or government agencies shall at all times be accountable to the Attorney-General in the discharge of those duties.
(2)In respect of the provision of legal services to the Government or government agencies, the Attorney-General may issue general or special instructions to those officers referred to in subsection (1).

7. Repeal

The Office of Attorney-General Act 19851 and the Office of Attorney-General Order 19902 are repealed.1Act No. 6 of 19862Order No. 15 of 1990
