JUDGMENT

The
appellants were convicted in the High Court of a variety of offences.
These included Murder, Attempted Murder, Common Assault
and Malicious
Damage to property. They were sentenced to various terms of
imprisonment by Monapathi J on the 20th of November 1998.

An appeal
on behalf of each one of the appellants was noted by attorneys K.T.

Khauoe
and Co. on the 3rd of February 1999.

The
Director of Public Prosecutions attempted to determine from Mr Khauoe
whether he intended to proceed with the appeal . He failed
to respond
to written enquiries made by the Director of Public Prosecutions.
This Court therefore called upon him to come to Court
and to inform
us whether he was proceeding with the appeal. Mr Khauoe has now
informed us that he is no longer acting for the appellants
and that
he has no further interest in the matter.

We have
decided that appellants should be informed of these developments.
Should they wish to pursue the appeal they should instruct
an
attorney to do so on their behalf or themselves take the necessary
steps to bring the appeal before the Court within 6 weeks
of the date
of service of this judgment on them should they fail to do so, the
appeal may be struck from the Roll at the next Session
of the Court
of Appeal in April 2001.

The
appeal is postponed to the next Session of the Court of Appeal for
compliance with the above. The Director of Public Prosecutions
is to
ensure that

this
judgment is properly served on the appellants.
