In this
appeal, the notice of appeal was filed with the Registrar of the
court on the 4th September, 1990. The record in the appeal
was only
filed with the Registrar on
the 28th of October, 1991. In terms of
Rule 3(7) of the Court of Appeal Rules 1980, the appellant is
required to file with the Registrar
five copies of the record and
serve
two copies on each Respondent not later than three months

after the
notice of appeal has been filed. In the present case therefore the
record in this matter has been filed more than nine
months late.
There is no application for
condonation before this court.
Accordingly the appeal is struck from the roll with costs.
