Given on the 1st March, 2005 by the Honourable Mrs Justice A.M. Hlajoane
The Plaintiff in this case, a businessman of Mafeteng, had instituted action against the Defendants claiming damages in the sum of seventeen thousand, one hundred and forty-five maluti (M17,145) as costs of repairs, and thirty thousand and six maluti fifty nine lisente (M30,006.59) for loss of earnings with interest and costs.
Plaintiff has shown in his papers that he is claiming for damages as a result of a collision between his vehicle and that of the First

Defendant. He further showed that First Defendant's vehicle was being driven by the Second Defendant during the collision, thus making his employer liable as he was acting within the scope of his employment.
The matter was ripe for hearing as pleadings were closed, when it was placed before me. However, the matter was decided in chambers as Counsel on both sides had reached a settlement. They had agreed that judgment be entered by consent in the sum of twenty thousand maluti (M20,000) plus taxed party and party costs.
Their settlement was thus made an order of this Court.
