An Act to make provision for the salaries of members of the National Assembly and SenateEnacted by the Parliament of Lesotho.

1. Short title

This Act may be cited as the Members of Parliament Salaries Act 1998.

2. Commencement

This Act shall be deemed to have come into operation on the date of the first meeting of the Fifth Parliament of Lesotho.

3. Interpretation

In the Act, unless the context otherwise requires—"Assistant Minister" means an Assistant Minister of the Government of Lesotho in accordance with section 93 of the Constitution;"Leader of the Opposition" means a member of the National Assembly who is the leader of the political party or coalition of political parties who commands the majority in the opposition and his party or coalition has at least 25% of the total membership of the National Assembly;"member" means a member of Parliament;"member of Parliament" means a member of the Senate in accordance with section 55 of the Constitution or a member of the National Assembly in accordance with section 56 of the Constitution;"Minister" means a Minister of the Government of Lesotho in accordance with section 87 of the Constitution;"sitting allowance" means an allowance that shall be given to a member of Parliament during a parliamentary sitting subject to the Regulation the Minister may, in consultation with the Minister responsible for Finance, determine;"Statutory member" means a member who holds a statutory position as defined by the Statutory Salaries Act 19721.1Act No. 8 of 1972

4. Remuneration

(1)A member specified in the first column of Schedule 1 shall be paid the annual salary specified in the second column of that Schedule and given the category of allowances and privileges specified in the third column of that Schedule opposite to the title of responsibilities of the member.
(2)The categories of allowances and priviledges are specified in Schedule 2.

5. Pensions

(1)A member other than a member who is a Principal Chief who has served as a member for a countinuous or cumulative period, of not less than 10 years and who does not earn a pension under the Pensions Proclamation 19642, shall be entitled to a pension on retirement.2Proclamation No. 4 of 1964
(2)A member who is a Principal Chief or earns a pension under the Pensions Proclamation 1964 and who has served as a member for a continuous or cumulative period of 10 years may, on retirement, elect whether to receive a pension granted under subsection (1) or the Pensions Proclamation 1964 and shall; in writing and within 30 days from the date of his retirement, inform, the Government Secretary of his decision.
(3)Where a member who is in receipt of a pension granted under subsection (1) is employed in an office whose emoluments are paid out of the Consolidated Fund, that member shall, within a period of one month after accepting such employment, elect whether to receive a pension granted under (subsection (1) or the Pensions Proclamation 1964 and shall, in writing and within 30 days from the date of his retirement, inform the Government Secretary of his decision.

6. Gratuity

(1)At the dissolution of Parliament or when a member ceases to be a member he shall be paid a gratuity of 25% of the total salary he has earned during the life of the Parliament or part thereof.
(2)Notwithstanding subsection (1), a member who is a Minister or an Assistant Minister of Government shall be paid a gratuity of 25% of the total salary he has earned after every 2 years of service.

7. Salaries, pensions etc to be charged out of Consolidated Fund

There shall be charged and paid out of the Consolidated Fund all such sums as may from time to time be granted by way of salary, pension, gratuity or other allowances and expenses in pursuance of this Act.

8. Regulations

The Minister responsible for Law and Constitutional Affairs may—
(a)make Regulations generally for giving effect to the provisions of this Act; and
(b)in consultation with the Minister responsible for Finance, make Regulations to amend the Schedules to this Act.

9. Statutory member

A member elected to the statutory position of Speaker or Deputy Speaker of the National Assembly or President or Deputy President of the Senate shall enjoy the same allowances and privileges as a Minister, and be entitled to a pension and gratuity as in sections 5 and 6.

1.Fully furnished rent free government house and maintained surroundings or payment of housing allowance to an amount of M3,000 per month.
2.Free utilities (electricity, water and telephone).
3.A tax free expense allowance to an amount of M5,000.00 per month in respect of the Prime Minister and M4,500.00 per month in respect of the Deputy Prime Minister.
4.A tax free entertainment allowance as the Minister responsible for Law and Constitutional Affairs may, in consultation with the Minister responsible for Finance/determine.
5.Personal aide, gardeners and house helpers.
6.A chauffeur-driven government vehicle with full security.
7.A utility vehicle.
8.Spouse chauffeur-driven government vehicle.
9.3 days leave entitlement per month.
10.Loan for the acquisition of a vehicle and a house of such an amount as the Minister responsible for Law and Constitutional Affairs may, in consultation with the Minister responsible for Finance, determine.
11.10 days holiday at Government expense for self and spouse every 2 years.
BMinister, Assistant Minister and Leader of the Opposition
1.Fully furnished rent free government house or payment of housing allowance to an amount of M3,000.00 per month.
2.Free utilities (electricity, water and telephone).
3.A tax free expense allowance to an amount of M4,000.00 per month.
4.Personal aide, gardener and house helper.
5.A chauffeur-driven government vehicle with bodyguard.
6.A utility vehicle.
7.3 days leave entitlement per month.
8.Loan for the acquisition of a vehicle and a house of such an amount as the Minister responsible for Law and Constitutional Affairs may, in consultation with the Minister responsible for Finance, determine.
CMember of the National Assembly
1.Fully furnished rent free government house or payment of housing allowance to an amount of M1,500.00 per month.
2.Free utilities (water, electricity and telephone).
3.A tax free sitting allowance to the amount of M100.00 per day.
4.A tax free constituency allowance to an amount of M300.00 for the lowlands and M500.00 for hardship areas per month.
5.A tax free constituency secretarial services allowance as the Minister of Law and Constitutional Affairs may, in consultation with the Minister responsible for Finance, determine.
6.Loan for the acquisiton of a vehicle and a house of such an amount as the Minister responsible for Law and Constitutional Affairs may, in consultation with Minister responsible for finance, determine.
